End User License Agreement

This is the agreement you accept by installing or using PCAPNG Analyzer Pro. See also the Refund & Support Policy.

This End User License Agreement (“Agreement”) is between you and Stuart Mathieson (“Licensor”) and governs your use of the PCAPNG Analyzer Pro software, including any documentation that accompanies it (together, the “Software”). By installing or using the Software you agree to this Agreement. If you do not agree, do not install or use the Software.

License Grant. Subject to your payment of the applicable purchase price, Licensor grants you a personal, non-exclusive, non-transferable license to install and use one copy of the Software on devices you own or control, for your own internal use.
Restrictions. You may not: (a) redistribute, sell, rent, lease, sublicense, or otherwise transfer the Software or your license key to any third party; (b) reverse engineer, decompile, or disassemble the Software except to the extent applicable law expressly permits; (c) remove or alter any proprietary notices in the Software; or (d) use the Software to provide a commercial hosted or bureau service to third parties.
Ownership. The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software.
Third-Party Components. The Software incorporates open-source components listed in the accompanying THIRD-PARTY-NOTICES file. Those components are governed by their own license terms, which apply to those components in place of this Agreement.
Local Processing; No Data Collection. The Software processes capture files locally on your device and does not transmit your files or their contents to Licensor or any third party. The sole exception: if you enter a license key, the Software sends that key and a product/version identifier to Licensor's license-verification provider (keygen.sh) to validate it, both when entered and periodically thereafter, solely to confirm the key remains valid. No capture data or analysis results are included in that or any other transmission.
Updates. Licensor may make updated versions of the Software available through the store from which you purchased it, but is not obligated to provide updates, upgrades, or support.
Refunds. Refund eligibility and process are set out in Licensor's Refund & Support Policy, available on this website. Where a refund is granted, Licensor may deactivate the license key associated with the refunded purchase. A refund is offered as a customer-service matter and is not an admission that the Software is defective or that Licensor is liable for any loss (see Sections 8-9).
Disclaimer of Warranty. THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NETWORK CAPTURE ANALYSIS RESULTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY BE INCOMPLETE OR INACCURATE; DO NOT RELY ON THEM AS THE SOLE BASIS FOR ANY SECURITY, LEGAL, OR OPERATIONAL DECISION.
Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE. Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law, including any non-excludable statutory consumer guarantees in your jurisdiction.
Termination. This Agreement terminates automatically if you breach it. On termination you must stop using and delete all copies of the Software.
Governing Law. This Agreement is governed by the laws of the jurisdiction in which Licensor resides, without regard to conflict of laws principles, except where the mandatory consumer law of your place of residence applies instead.
